Thick-skinned Yvette Hamilius resilience cannot be explained other than by assuming she has been paid a truckload of money, or blackmailed in some sordid manner, to endure the barrage of persistent attacks from hundreds who feel, and quite rightly may we add, totally conned by the company that she represents.
There is no need to transcribe the article that appeared on the Luxembourgeois online newpaper www.wort.lu but we will add that, if lawyers acting for Ms. Anne Vershchaffel succeed in having foreclosure proceedings, brought by Jyske Bank, declared null and void due to using an unregulated valuation company from Girbraltar on a Spanish property, the 200 or so “customers” of Mrs. Hamilius will be able to sleep a bit better.
Because the concomitant effect of attaining this ruling is not only that Landsbanki will be barred from bringing foreclosure proceedings in Spain as they too used one of such unregulated businesses but also, that the mortgage loans would be automatically void by application of article 6.3 of the Spanish Civil Code:
Legal agreements that contravene obligatory or prohibitive laws are null and void, unless applicable laws envisage a different legal outcome.
What on earth does this woman think she is doing. Have the Landsbanki victims in France & Spain not suffered enough without rubbing salt in their wounds. This has the hallmarks of a very desperate lady who is unable to take criticism of any sort. Mrs Hamilius there is such a thing as free speech even if you do not practise this in your own country, what are you afraid of? The time is now to talk to these poor victims and not “throw your toys” out of the pram, you are practising kindergarten tactics. Are you being serious when you state you are going to sue 180 individuals for defamation how do you expect to get evidence from all these people, perhaps most of which have not even expressed any opinions against you or are even know what is going on. Does you not already realise that a judge in Spain has ruled in favour of a couple against Landsbanki. By the way Mrs Hamilius I am not a Landsbanki victim but an interested follower of the Equity Release frauds committed by Landsbanki, Danske Bank and Nordea Bank (operating out of Luxembourg) as well as Rothschild to name but a few. Get your act together honey and dig a little deeper into the fraudulent activities of Landsbanki, it is your duty as the liquidator to do so. Perhaps then you will understand the grievances of these victims. By the way if you want to include me in your forhcoming plan to sue these people you can by contacting this web site. Is there not another Criminal Case in France regarding the Criminal abuse and manipulation of the Security Cover Ratio , SCR which was manipulated in so many cases in order to trigger the seizing of property within weeks of the Bank closing its doors? In fact, in October 2008!
Also, why is it that whilst transactions out of the dying Landsbanki were stopped and the doors of the Bank were closed early in August 2008 and clients could no longer get transfers of their funds in personal accounts, did Luxembourg not declare the Bank officially Bankrupt until December 2008?
We know they placed the official “suspect” period on April 8th 2008, but in their accounts they appear to have continued, with closed doors, ‘investing’ in ice cubes and rotten fish?
If their doors were effectively closed to our transfers and business in August, how can they have continued to play with money behind closed doors and then only declare themselves bankrupt when they had finished playing and transferring out of Luxembourg?
Who made these decisions and who was supervising and approving these dealings behind closed doors?
Why did Franz Prost feel he would do well to resign?
When Franz Prost resigned, the administrator continued to Carry on as if there were no questions to answer and now she says basically she was only obeying orders, doesn’t she? Read the article linked from Wort.lu
What we want to know is, who was giving the orders to Carry On ignoring the Criminal questions main European countries were asking their Criminal Judges?
These Equity Release scam cases are CRIMINAL cases with many questions that need answering and it becomes clearer by the day why Franz Prost thought it necessary to resign and leave Mme Hamilius to do it her way with the help of the Luxembourg Judge Karine Guillaume, doesn’t it?
These are points we are all looking at in all countries concerned by these scams.
Let us hope the international aspect of these scams leads the judiciary of Spain and France to consult so that the European Consumer Rights can be properly implemented and that Luxembourg will wake up to the need to change their ways if they want consumers to trust Luxembourg, as we all did, ever again.
For the moment, how in the world can anyone trust banks based in Luxembourg with their money or their assets? Look what happened to us all, when we trusted Luxembourg?
Security Cover Ratio, big name but just another way of fiddling the figures to give them a chance to cancel the contracts. Will they ever be trust in Luxembourg anymore. I doubt it, they have certainly been going through a bad time recently and rightly so. Someone asked me the other day where was the place to invest securely. Why they asked me, I dont’ know, who does. Went on to say that she thought the banks were a good bet so invested in Landsbanki. At the moment she has managed to recover 50% of her money, the other 50% she has given up on. What a mess. Now I know some folks will say that it serves you right for trusting Landsbanki, but what do you do with your hard earned cash. Institutions, like the London Greater Council and police authorities, as well as other local councils trusted this bank and were caught out. Luxembourg has a lot to answer for and they are trying to sue real people to take the heat of themselves. Well go ahead, if you want some real publicity you are going about it in the right way. I would have thought that these Landsbanki victims would relish such a case.
Sounds like a rat trying to escape down the first drainpipe she can find. Evidently feeling the heat and trying to pass the can back to the initial liquidator who apparenty resigned, for what reason we can only guess. Then of course the next person to blame is wait for it “here comes the Judge” the one and only Karine Guillaume, did I read somewhere that Himilius and the judge are flat mates, correct me if I am wrong and I will put it right. I heard Hamilius is seizing the rent of victims in France. She seems to forget that all should be treated with equality, which begs the question of who is she protecting and who is she favoring above the others?
She is attacking creditors as if they were debtors for the last four and a half years .
However it doesn’t sound as if she is protecting the judge Karin Guillaume who is her supervisor does it? She blames everyone but herself for the Landsbanki mess.
All other victims of Luxembourg Equity Release fraud in Spain, whatever the Bank, should be pleased with the mess Mrs Hamilius is making as it helps show the world what Luxembourg has been doing to 600 pensioners and perhaps help the Spanish Judges in these cases. Playing the blame game in public is not very dignified for a lawyer is it but then Luxembourg is Luxembourg and they sink to unfathomed depths in order to abuse those who trusted Luxembourg don’t they?

Liquidator Hamilius starts to defense her self. This is necessary because 2 complaints – France and Luxembourg- put her in the role of the defendant. Why an official appointed Liquidator – the representative of the State Luxembourg in this case- must hold a press conference and need journalist to face up with this complaint. She is a lawyer and normally she has to know to play this game. Here she shows the lack of sovereignty. She is wounded that’s for sure that indicates that she will issue a complaint against the Lawyers Maingain + Bodig who have lodged the Luxembourg complaint. But more interesting is that she will take influence over the media to the job of the investigative judge. She transported in the newspaper that the Luxembourg complaint must be rejected because there are already some final judgments in civil lawsuits. Her hope is that the investigative judge will read this nonsense argument and should follow her. But every lawyer and judge knows that criminal act is much more higher leveled as civil lawsuits. She starts to use the media to transport messages to her own benefit, thereby the truth is not her first choice. We read that she said there is already an agreement with judge Van Ruymbeke in Paris that Landsbanki victims “only” should pay 20%. She didn’t mentioned 20% from what? She said further that she forgoes of 80% )= 200,0 Mio € ! First there is no agreement between Van Ruymbeke and Luxembourg. This is not possible because Van Ruymbeke makes the investigation which comes before the Grand Tribunal and in the phase of investigation there is no room for negotiations or agreements. The 20% (from what?) was an suggestion of Hamilius at the summon 11.Dec.2012 in Paris. Nothing more.
Second if she generous forgoes 80% she embezzies that she has already confiscate all cash amounts and portfolios from all victims accounts. This was done in summer 2012. So she has already 80% on her account. She is not able to forgoes something what she already has confiscate.
That’s the method of Hamilius : announce lies as facts, tell only the 1/2 of the truth and use all journalist who has not enough knowledge about this case Landsbanki. I’m sure she will get back aTornado from the French and Spanish fellows.

From what we hear this advocate Hamilius has put 2 complaints in Criminal court in Luxembourg attacking 2 advocates, one Belgian and one from Luxembourg. Also she attacks 200 people for defending themselves against her attacks and false accusations of being debtors and for wanting proper accounting and justifications of all investments by Landsbanki.
Everyone needs proof of every investment. Do they have it? Answer is NO.
Everyone wants to know where the money has disappeared to as there is little proper justification of investments. Is there any proof that the investments were really made? Answer is NO.
We need the answers to all these questions Luxembourg doesn’t want to ask, no?
Mrs Hamilius is attacking these 2 advocates for diffamation. That means she says the accusations made by hundreds of victims, old clients of Luxembourg Banks and their lawyers in France, Spain, Luxembourg, the UK, iceland, Sweden, Germany, Holland and Belgium are telling lies, doesn’t it?
That means she also says that all the accountants in these European countries who have examined the ridiculous accounting done either before or during the Landsbanki failure are also lying when they say the accounting is a Circus or is pure rubbish!?
These professional people are shocked when they examine the accounts Landsbanki administration has sent to the victims! They can’t believe it. We can’t believe it. No one can believe it but Mrs Hamilius thinks the Luxembourg journalists should believe it! There has been gross negligence or worse and this is serious.
Are Luxembourg journalists stupid? We think they are not stupid and they will do better investigations than any Judge Commisaire has done in 4 years!

Maybe Mme Hamilius is scared the journalists will start looking and seeing there is a big problem in Luxembourg and Mrs Hamilius and the Judge Commissaire have failed in their first duty of ensuring equality and checking the legality of what was done by the Bank and examining the accounting very carefully to ensure there has been no manipulation and no fraud as the Judges believe there has been?
What the journalists have to do is examine closely all the accusations against the Landsbanki Luxembourg .Circus. They have to examine the mails sent to them by Mrs Hamilus, as they tried for four and a half years to negotiate and explain all the terrible mistakes in the accounts and all the money which vanished. The clients could never be heard and Mrs Hamilius was not willing to discuss anything.
Why is Luxembourg getting called bad names across Europe?
This is what the journalists should investigate, or will Mrs Hamilius attack them for slander, defamation etc etc as well?
Can everyone who is demanding answers from Luxembourg be attacked for slander for saying there are serious questions to answer?
The Judges are also saying there are serious questions to answer.
Didn’t Landsbanki already lose a case in European Court against Mrs Hamilius versus employees of Landsbanki?
How can all these professional, highly qualified and respected people across Europe, be wrong, just because Luxembourg doesn’t want to examine the accusations of fraud, manipulation, false accounting, vanishing money, ultimatums, harassment and lack if respect for those who thought they were safe in Luxembourg as George and Glenn said.
The principal and gross errors of Mme Hamilius , in my opinion, is that she did not examine and report on all of the grave and serious actions taken by the bank nor investigate the accusations of false accounting and did not act with complete impartiality as she should have done as administrator.
Late purchase of sinking Icelandic bonds after the bank had closed its doors to the serious detriment of all the Equity Release clients is just one of the extremely serious omissions in her duty as administrator.
The clear abuse and manipulation of the SCR Security Cover Ratio in order to demand serious money, seize assets and convert creditors to debtors which occurred around one month after the bank ceased operations is another great scandal Mme Hamilius failed to report, correct or rectify.
The list is long and the questions will be answered in Court.
The journalists are not unintelligent and they know that if they want the truth, they have to check everything Mme Hamilius claims.
There is much going on that is still being swept under the carpet and the best way to do this is by way of the courts. Mme Hamilius I understand is not only the administrator of Landsbanki but also a type of lawyer and as such is an officer of the court. She does’ as you say have a duty to investigate all angles matters not only the winding up of Landsbanki, but more importantly the fraudulent activities in relation to Landsbanki embarking on what is now perceived to be a fraudulent equity release scheme both in France & Spain. If she has the slightest doubt in her mind that these schemes were fraudulent and the subsequent illegal transfers of monies from clients private accounts to Lex Life (an insurance company within the Landsbanki group, then surely this is fraud in its own right. Mme Hamilius as a lawyer should be aware of this. I thought that under Luxembourg law thast monies paid into an insurance company had to be held in a seperate account and were guaranteed by the Luxembourg authorities. This cannot be used to pay off other creditors of Landsbanki, who themselves are creditors. One would have thought that if Mme Hamilius was in the right then she does not need to up the anti by suing Landsbanki victims. This reeks of desperation. In the end what will make the difference is for the courts to decide or does it? Hamilius seems to take no notice of the various judgements of the courts in Spain & France where findings have been made for the claimants. No doubt if she carries on with this denial she will, together with the Luxembourg authorities end up in the European Courts of Justice.. Does she not realise that these victims will never give up. Finally you are correct in your analysis of the press. They are not stupid and will not report anything that they have not thoroughly investigated. To do so would open the doors for their paper to be sued. These schemes are more and more coming out in the public domain as fraudulent. A recent article on the internet shows that HSBC have been ordered by the US Financial regulator to pay compensation to their customers who have had their houses repossessed due to mortgage irregularies. Perhaps this link will bring some light on to the subject. I think after reading some of these comments you will understand the attitude of Mme Hamilius, the courts and the regulatory authorities. It would seem due to the Luxembourg culture that this country is a closed shop. The only newspapers that show any back bone are Paperjam & WORT. Well done you two. The above link refers to someone caught up in the Landsbanki scam to resort to unethical practises to get himself out of his dire situation. Whilst one cannot condone his methods, it just goes to show how the Landsbanki situation affects people and the lengths he felt he had to go to secure his future.
