Mark Coutanche and Stephen Dewsnip have been requested to turn up at the Denia Court to be notified of criminal charges being bought against them.
The General Directorate of Police and the Guardia Civil in Madrid have been issued “with Code 1” requests (current address and/or whereabout search warrant) so that they can be notified of ongoing criminal proceedings in Spain.
According to the warrant, the last known address was Paseo de la Castella N 35, 3rd floor, in Madrid, an address that coincides with that of their Madrid offices; it appears that an attempt to deliver a copy of the summons bore no fruits.
The warrant was issued on the 26th November 2013 and ends on the 26th November 2018.
Making service of process difficult has become a useful tool for any lawyer acting for Equity Release banks and NM Rothschild & Sons, a bank known for redifining the meaning of the term “double-standards”, is not going to miss an opportunity to make the lives of their clients-turned-victims a tad more miserable.
N.M. Rothschild & Sons is accused of selling mortgages to Spanish-based pensioners as a tool to defraud the Spanish Tax Office, albeit as a legal product, alongside deliberately concealing crucial data that would prove that their Equity Release product was impractical, from an investment point of view.

Great news. But the only place that Dewsnip and Coutanch will NOT be is in Spain of course.
Now that 2014 has arrived, would it not be a good idea for all banks including Rothschild, Danske Bank, Nordea Bank, Sydbank/Nycredit, SLM (Surrenda Linked Mortgages) Barclays to name but a few, look seriously at the mayhem they have created in Spain and sort it out. If not they deserve everything they have coming to them.
If they ever turn up in Spain they will be arrested and kept in Jail until the warrant has been served on them. Perhaps now is the best time for them to phone their Spanish lawyers and sort out their problems. If they have nothing to fear then why not face the problem head on.
One of our members has informed Erva that they have just emailed the papers in Guernsey (Guernsey Post) to see if the story is newsworthy enough. At least Dewsnip & Coutanche will be made aware of the outstanding warrant.
I hope these two bandits turn up to answer the criminal complaint, if not they will never be able to set foot in Spain again, without the fear of being arrested. In any event, can they be found guilty by default. Apparently even though we have the freedom of movement in Europe, the Spanish authorities have a good system for finding fugitives, if not at the border, airports or ferry ports, they have a system that is reported to every hotel/ hostelry in Spain. The passports/identity documents will be on every computer and as soon as the fugitive checks in, the message is sent to the local police. There is no escape.
