Euan Armstrong and Antonio Flores discuss the denunciation to be lodged with the Spanish Hacienda, that is to be held on the 9th of April 2012, at 12.00 am, in the Delegacion de la A.E.A.T. de Málaga (map). Claimants will gather outside at 11.30 a.m. for a peaceful protest and it is expected that the different press will cover the action.
The denunciation consist of a writ to the Tax Office informing them that the denounced bank(s), with a view to capture new clients, offered a product that supposedly would mitigate the impact of Inheritance and Wealth Taxes when, as it has turned out, actually consisted on a tax fraud proposition for such taxes could have never been avoided.
The writ will be standardized and denouncers will just have to fill out their personal details, the bank involved and the date of signing of the mortgage deed. We will load the denunciation on this website on the following days. Denouncers will be able to fill out the form at home, and bring it to the meeting, or fill it out on day and have it signed.
The only document that will be required is a copy of the mortgage deeds, or escritura de préstamo hipotecario. This can be sent to either Euan or Ian, or can be brought to the meeting.

Well done Euan. Your dedication to ERVA and the time you spend completely in your own time and expense is much appreciated by us all. I would agree with your comments and I am shocked that the Hacienda (Spanish Inland Revenue) could be in a position to lose some 250 million Euro in lost taxes. One would think that the Spanish Government would wake up to the idea of what these Scandanavian banks have been selling. It is time that they took a leaf out of the Danish Tax Authoriites book and declared these schemes non other that a vehicle for investment purposes to feather their own nests at the expense of their clients and more importantly the Spanish Government. Lets hope that by denouncing these banks they will finally start a full investigation into these schemes. Our thanks also to the lawyers who have worked tirelessly at their own expense to highlight these schemes, we are blessed by so much generosity. There is no doubt in our mind that property rich pensioners have been systematically targeted by promises of reducing/avoiding/evading paying both IHT and Wealth Taxes. From what I have read it would seem that some banks lawyers have in fact admitted that these banks are not regulated in Spain for these types of products.
To all members. Please be aware that the term demonstration is perhaps a little overstated. Our plan is to meet outside the Hacienda at 1130 on Monday 9 April to present our individual denuncias to the tax office, it will be peacefull gathering place where we can get to know each other. This will not be a demonstration as perhaps the British understand. We are having good responses, so please join us, it is in your interest to submit your own personal denuncia. As the saying goes “If you are not in it – you can’t win it” So lets support each other and the Association the Officers of which have worked tirelessly in their own time and at their own expense to bring justice to us all.
